J.M. Huber Corporation, its subsidiaries and affiliates (“Huber”) is a family-owned global manufacturing company.  Its operations encompass the manufacture and distribution of specialty chemicals, minerals and wood products as well as land management activities. Huber understands that your privacy is highly important to you.  Huber may process your personal data in our capacity as a data controller in the administration of our recruiting and hiring initiatives.  Accordingly, Huber is committed to respecting your privacy and protecting your personal data, which is any information that is capable of identifying you as an individual person.

You are being provided  a copy of this privacy notice because you are applying for work with us. This notice makes you aware of how and why your personal data will be used, namely for the purposes of the recruitment and hiring process, and how long it will usually be retained. This Notice  provides you with certain information that must be delivered under the General Data Protection Regulation ((EU) 2016/679) (“GDPR”) to the extent GDPR applies to you.

Introduction

This Privacy Notice only applies to the personal data of job applicants, potential candidates for employment, and Huber’s optional recruiting programs and events. It does not apply to Huber’s employees, contractors or clients for whom a separate Huber General Policy on Data Protection and Privacy of Personal Data applies.

As used in this Privacy Notice, “personal data” means information that identifies job applicants and potential candidates for employment with Huber, either submitted as part of the online application and/or through alternative channels (e.g., via professional recruiting firms).

Huber will process your personal data in accordance with this Privacy Notice, unless such processing conflicts with the requirements of applicable law, in which case, applicable law will prevail.

By submitting your personal data to Huber, you acknowledge that:

  • You have read and understood this Privacy Notice.
  • Your personal data may be transferred and processed worldwide, including countries that may not be deemed to provide the same level of data protection as your home country, for the purposes and in the manner specified in this Privacy Notice.
  • You are not required to provide any requested information to us, but failing to do so may result in not being able to continue your candidacy for the job for which you have applied.
  • All of your representations are true and correct to the best of your knowledge and belief, and you have not knowingly omitted any related information of an adverse nature. Providing any inaccurate information may make you ineligible for employment.
  • This Privacy Notice does not form part of any contract of employment offered to candidates hired by Huber.

Data Protection Principles

We will comply with applicable data protection law and principles, which means that your personal data will be:

  • Used lawfully, fairly and in a transparent way.
  • Collected only for valid purposes that we have clearly explained to you and not used in any way that is incompatible with those purposes.
  • Relevant to the purposes we have told you about and limited only to those purposes.
  • Accessible to you in order to maintain the accuracy of your information.
  • Kept only as long as necessary for the purposes  described in this Privacy Notice.
  • Kept securely.

Personal data Huber collects and means of collection

The types of personal data that Huber requests from you and the ways that Huber processes the data are determined by the requirements of the country in which the position is located, and not the country in which you reside. Should you apply to more than one location or should the role to which you apply be available in more than one country, the types of personal data Huber requests from you and the ways that Huber processes the data are determined by the requirements of all the countries in which the position is located.

In connection with your application for work with us, we will collect, store, and use the following categories of personal information about you:

  • The information you have provided to us in your curriculum vitae and covering letter.
  • The information you have provided on our application form, including name, title, address, telephone number, personal email address, date of birth, gender, employment history, qualifications, etc.
  • Any information you provide to us during an interview.
  • Any tests results you may have participated in during your recruitment process.

Huber usually collects personal data directly from you when you apply for a position with us, such as your name, address, contact information, work and educational history, achievements, and test results. Huber also may collect personal data about you from third parties, such as your references, prior employers, educational institutions, Huber employees with whom you have interviewed, and employment background check providers, to the extent this is permitted by applicable law.

Sensitive personal data is a subset of personal data and includes ethnicity, health, trade union membership, philosophical beliefs, sexual orientation, as well as other categories as allowed by law. Huber does not seek to obtain and will not collect such data about a candidate unless permitted or required to do so by applicable laws (e.g., government reporting in the US).

Use of your personal data

For the purposes of GDPR, Huber processes your personal data on the following grounds:

  • Article 6(1)(f) of GDPR as it is in our legitimate interest to decide whether to appoint you to the job vacancy since it would be beneficial to our business to appoint someone to that role; and
  • Article 6(1)(b)of GDPR as we also need to process your personal information to decide whether to enter into a contract of employment with you.

Huber collects and uses your personal data for legitimate human resources and business management reasons including:

  • Assess your skills, qualifications and suitability for potential current employment, as well as for future roles that may become available;
  • Communicate with you about the recruitment process;
  • Administrative functions such as recordkeeping in relation to recruiting and hiring;
  • Ensuring compliance with legal or regulatory requirements, including diversity and inclusion requirements and practices;
  • Conducting criminal history checks as permitted by applicable law;
  • Protecting Huber’s legal rights to the extent authorized or permitted by law;
  • Complying with legal or regulatory requirements;
  • Emergency situations where the health or safety of one or more individuals may be endangered.
  • We may also analyze your personal data or aggregated/pseudonymized data to improve Huber’s recruitment and hiring process and to augment our ability to attract successful candidates.

Huber may desire to retain your personal data to consider you for future employment opportunities. In such event, Huber will retain it for a limited amount of time. 

Data recipients and international data transfers

Your personal data may be accessed by recruiters and interviewers working in the country where the position for which you are applying is based, as well as by recruiters and interviewers working in different countries within Huber’s global organization. Individuals performing administrative functions and IT personnel within Huber may also have a limited access to your personal data in order to perform their jobs. Huber has put in place legal mechanisms designed to ensure adequate data protection of your personal data that is processed by Huber within its global organization, including the transfer of your personal data to countries other than the one in which you reside.

Huber uses third-party service providers for its recruiting software system. SAP hosts and supports Huber’s recruiting software system.  Huber also shares your personal data with other third-party service providers that may assist us in recruiting talent, administering and evaluating pre-employment screening and testing, and improving our recruiting practices.

Huber maintains processes that are designed to ensure that any processing of personal data by third- party service providers is consistent with this Privacy Notice and protects the confidentiality, availability, and integrity of your personal data.  All our third-party service providers and other entities in the group are required to take appropriate security measures to protect your personal information in line with our policies. We do not allow our third-party service providers to use your personal data for their own purposes. We only permit them to process your personal data for specified purposes and in accordance with our instructions.

Data retention of your personal data

If you accept an offer of employment by us, any relevant personal data collected during your pre-employment period will become part of your personnel records and will be retained throughout and for a period after your employment with Huber in accordance with specific country requirements. If Huber does not employ you, we may nevertheless continue to retain and use your personal data for a period of time (which may vary depending on the country) for system administration purposes, to consider you for potential future roles, and to perform research. If you elect to join a recruiting program, we may retain your personal data to consider you for future employment opportunities.

Security of your personal data

Huber has implemented generally accepted standards of technical and operational security to protect personal data from loss, misuse, alteration, or destruction. Only authorized personnel of Huber and of our third-party service providers are provided access to personal data, and these employees and third-party service providers are required to treat this information as confidential. Despite these precautions, we cannot guarantee that unauthorized persons will not obtain access to your personal data.

We have put in place procedures to deal with any suspected data security breach and will notify you and any applicable regulator of a suspected breach where we are legally required to do so.

Your rights

Huber takes reasonable steps that are designed to keep your personal data accurate, complete, and up-to-date for the purposes for which it is collected and used. Huber also has implemented measures that are designed to ensure that our processing of your personal data complies with this Privacy Notice and applicable law.

Where GDPR applies, under certain circumstances you have the right to:

Request access to your personal information (commonly known as a "data subject access request"). This enables you to receive a copy of the personal information we hold about you and to check that we are lawfully processing it.
Request correction of the personal information that we hold about you. This enables you to have any incomplete or inaccurate information we hold about you corrected.
Request erasure of your personal information. This enables you to ask us to delete or remove personal information where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal information where you have exercised your right to object to processing (see below).
Object to processing of your personal information where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground. You also have the right to object where we are processing your personal information for direct marketing purposes.
Request the restriction of processing of your personal information. This enables you to ask us to suspend the processing of personal information about you, for example if you want us to establish its accuracy or the reason for processing it.
Request the transfer of your personal information to another party.

To help protect your privacy and security, Huber will take reasonable steps to verify your identity before granting you access to your personal data. Huber will make reasonable attempts to promptly investigate, comply with, or otherwise respond to your requests as may be required by applicable law. Depending upon the circumstances and the request, Huber may not be permitted to provide access to personal data or otherwise fully comply with your request; for example, where producing your information may reveal the identity of someone else. Huber reserves the right to charge an appropriate fee for complying with your request where allowed by applicable law, and/or to deny your requests where, in Huber’s discretion, they may be unfounded, excessive, or otherwise unacceptable under applicable law.

Cookies and other tracking technologies

Huber may use cookies and other tracking technologies to provide individuals with a customized online experience, to send relevant information about careers and opportunities at Huber, and to analyze the effectiveness of our recruiting efforts and resources.  Web browsers are usually set by default to accept cookies but you may easily change this by modifying the settings of your browser.  However, please note that should you choose to disable cookies, you may be unable to use parts of our application.
